1.A This website is provided by Winesonline Limited for your personal use subject to the following terms and conditions. By using the Website you agree to be bound by these Terms.
1.B This Website and the information on this Website may be changed or updated without notice.
1.C Winesonline has taken every effort to ensure that the information on this website is correct, accurate and up to date. However, Winesonline takes no responsibility whatsoever for information that is incomplete, inaccurate or out of date.
1.D All text and graphics on this website, unless specified, are directed solely at those who access the website from the UK mainland. Winesonline makes no representation or will not be held liable for any action placed upon the website by individuals from other locations.
1.E Winesonline assumes no responsibility whatsoever for any links to the Internet or other third party websites from its website. Once you activate these links you will leave this website and Winesonline will not be responsible, or liable, for the content of any other websites on the Internet to which you may visit thereafter.
1.F Winesonline also prohibits all persons from providing hypertext or other links to the www.wineon-line.co.uk website, (other than to our home page) from their web site or from a third party’s web site without our prior written consent.
Whilst using the site (by whatever means or device) you agree that you have read, understood and accept these Terms (as amended from time to time). If you do not agree to be bound by these Terms you may not use or access this site or place an order with us.
In these Terms, references to “we” or “us” are to Winesonline Limited (trading as www.wineon-line.co.uk), a company incorporated in England and Wales (registered number 09291675) whose registered office is at Louis Pearlman Centre, Goulton Street, Hull, HU3 4DL, ERYC. Our registered VAT number is GB 211 5685 27
The following Terms and Conditions do not affect your statutory rights as a consumer. By entering into any financial transaction with Winesonline Ltd (trading as wineon-line.co.uk) you are agreeing to our Terms and Conditions as below:
2.A It is against the law to sell or supply intoxicating substances to persons under 18 years of age in the UK. All customers must confirm prior to ordering their date of birth. Anyone under the age of 18 will not be allowed to place an order. If our delivery couriers are in doubt of the age of the recipient of an order they may request some form of ID. In the event that this is not satisfied they are not permitted to leave the wine.
3.A Delivery is £7.99 per address for all locations except the out of area locations listed in 3.B where it is £14.99 per address. These rates are set by our couriers to cover the additional services needed to get your goods to you in these locations. For a full pricing list click here.
3.B Our delivery locations are defined by the following categories;
– UK Mainland click here and refer to pages 1 through 9 for full postcodes list.
– Non-Mainland UK that will include Northern Ireland, Isle of Man, Guernsey and Isles of Scilly – click here and refer to pages 9 and 10 for a full list of postcodes
– We can ship anywhere in the Republic of Ireland rates start from £18
– 3.C For anything other than the UK Mainland we are cannot guarantee 24-hour delivery but the price remains £7.99
3.D On mainland UK orders placed after 2pm we will dispatch your order the following day on 24-hour delivery, excluding weekends. Orders placed after 2pm on Friday will be dispatched on Monday on 24-hour delivery.
3.E Saturday deliveries are possible, but must be chosen by the customer whilst in the cart. Unfortunately there is an additional charge for this service delivery rate +£12. Prices again are set by our courier and we make no profit on this service. Please ensure orders are placed before our 2pm cut off period so we can ensure your order will make that days dispatches. In the event it is us that has delayed your order, due to bonded stock delays for example then we receiver the right to dispatch on the ext available standard charge day, we will not use a Saturday service in the event of this.
Offered for all locations in and around Hull, up to and including 15-mile radios of HU3 4DL. It will be charged at the standard delivery rate £6.99 but will include any amount of consignments under this rate. All following postcodes will be delivered to on a same day basis on orders placed before 12pm.

NON-DELIVERY AND CANCELATION
4.A The placing of an order, paying for an order and receiving order confirmation from our site does not constitute a contract. A contract between you and us will only be formed on the dispatch to you of the products ordered unless we have notified you that we do not accept your order, you have cancelled your order in accordance with the instructions set out in the “Cancellations” section.
Non-acceptance of an order may be a result from one of the following:
– The product you ordered being unavailable from stock
– Our inability to obtain payment authorisation.
– Our inability to verify that you are aged 18 or over.
– There is an error within the identification, pricing or product description.
4.B If you believe a wine from Winesonline is spoilt or if a bottle(s) has broken then we will refund or replace it with the same wine or if this is not possible another similar wine of equal or greater value. If the delivery is outside the mainland UK we will refund the bottle(s).
4.C You may cancel your order for any reason up to and including 7 working days from the date of delivery of your order, provided all the bottles are unopened and intact. We will refund the price of the order excluding any delivery charge and less the cost incurred to collect the wine.
4.D Occasionally a wine you order may go out of stock. Or be held in Bond. If this is the case we will contact you to inform you of the potential delay or offer you an alternative wine of equal or greater value.
4.E Claims for non-delivery must be made within three weeks of your order date.
4.F Any complaint is taken very seriously and we endeavor to respond to complaints as soon as possible.
4.G We will always endeavor to deliver the correct vintage of the wine you have ordered. If the wrong vintage is delivered we will of course collect the wine if required and refund in full. Winesonline is under no obligation though to source the original vintage ordered if it is no longer available.
5.A You must register with Winesonline Ltd (trading as www.wineon-line.co.uk) and complete an account application form providing either business or personal details and proof or age before goods can be purchased. If the purchase is a gift for a third party then the recipient of the gift must also be aged 18 years or over.
5.B By registering you agree that the personal information that you provide when you register as a customer is true, accurate, current and complete in all respects.
5.C You will notify us immediately of any changes to the personal information by updating your details in the “My Details” section within your online account or by contacting us using the contact details below.
5.D You shall not impersonate any person or entity or misrepresent your identity or affiliation with any person or entity, including using another person’s username, password or other account information.
If any information provided by you is untrue, inaccurate, not current or incomplete or if we suspect that any information provided by you is untrue, inaccurate, not current or incomplete, we reserve the right to terminate your use of the site or your account.
5.E You must notify us immediately of any known un-authorised use of your account or any other possible breach in security.
5.F You agree that we may use personal information provided by you in order to conduct appropriate anti-fraud checks and to confirm you are of legal age if purchasing alcohol. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency and we may keep a record of that information.
5.G If the person receiving the order is unable to produce appropriate ID to confirm them to be 18 years of age or older then unfortunately our couriers will be unable to leave the products. Costs to redeliver the order then the consequence thereof shall be of the person making the order.
5.H To ensure that your credit, debit or charge card is not being used without your consent we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered credit reference agency whom may keep a record of that information. Be assured that this is done only to confirm your identity, and that your credit rating will be not be affected.
5.G Winesonline Ltd (trading as www.wineon-line.co.uk) engage in the use of social media, however should you wish to contact the company regarding any orders or any product enquiries please contact us either via telephone or email. Please note that Winesonline Ltd (trading as www.wineon-line.co.uk) social media is monitored. Any comments or posts should be within the recommended guidelines of that social media network and the UK Law. Any comments or posts that are deemed inappropriate, slanderous or abusive, either directed at other customers, other social media users or ourselves, will be recorded and may result in legal proceedings.
6.A For the ultimate security Winesonline does not store or even process your credit card details. All processing is done directly through either Sage Pay or PayPal.
6.B Whilst Winesonline makes reasonable attempts to exclude viruses or other destructive computer codes from the Website, it does not accept any obligation, gives no assurance and assumes no liability or responsibility (whether express or implied) in relation to viruses or such computer code. You should take all appropriate safeguards before using the Website or downloading from the Website.
6.C The Data Protection Act 1998 and all information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
PAYMENT AND PRICING
7.A All prices are quoted in pounds sterling, and may be per bottle or per case. The prices include UK duty and VAT. Prices are based on the minimum order. Ordering quantities below the minimum order may result in additional charges. Prices of the products do not include delivery charges. These will be detailed at the time of order and may vary according to the level of service required.
7.B We reserve the right to charge extra for any unusual delivery requirements or different locations.
7.C Unless otherwise agreed prices will remain those stated by us on the date of invoice prior to dispatch. No claims of any type or reductions after dispatch will be entered into.
7.D We reserve the right to alter prices without notice in the event of major currency fluctuations, changes in the rate of duty, VAT or other taxes, or other market conditions. We also reserve the right to terminate any special offer at any time, without notice.
7.E Any price or price list provided to you is for information and guidance purposes only and may contain discrepancies. It does not represent an offer to sell at the stated price and the prices are not legally binding to us.
7.F All prices and price lists in relation to your account are strictly confidential and must not be disclosed to any third parties. Quotations given for orders are valid for 7 days from the date of the quotation and are non-transferrable. All trade quotations are exclusive of VAT unless otherwise stated. Prices are subject to change without prior notice.
7.G In the unlikely event that a product you have ordered is listed at an incorrect price we will contact you by telephone or email before dispatching your products asking you to confirm if you still wish to proceed with your order at the correct price or cancel your order. If you do not confirm that you wish to proceed with the order within three days of the date of our email, we will consider this as a withdrawal of your order.
8.A Orders can be made online, in writing, email or by telephone. When we receive an order we have the right to assume the order is correct and accurate, no confirmation of order is either requested, necessary or waited on.
8.B When you have completed your order you will be sent an e-mail confirming your order. It will state what the products/services are, the cost, delivery and invoice details. If your order has been unsuccessful you will be made aware of the reason why and any possible explanations. Each party shall be responsible for any errors in its messaging or ordering.
8.C The products are not sold on a sale or return or exchange basis. We are unable to guarantee any minimum best before dates unless arranged prior to dispatch. If ordering for a specific date of consumption please call and check first.
9.A If for any reason beyond our control, we are unable to supply a particular product, we will notify you as soon as possible. Goods are available on a first come, first served basis and we are not liable if we are unable to supply a particular product. You will not be charged should stocks become exhausted and will be notified within 24 hours where possible of such and offered an alternative choice. Should you have been charged already, a refund for the part not in stock shall be applied.
9.B Discontinued lines or vintage products can become unavailable, if this should occur during your order process then you will be notified of the alternative products on offer. You will be refunded in full if the alternatives are not required.
9.C Suppliers may change bottle type, size, colour and labeling at any point with no prior notice. Whilst we endeavor to ensure all images are correct and up to date on the website we cannot guarantee the accuracy at any given point.
9.D Any special offers are made available only whilst stocks last, are on a first come first served basis and may be withdrawn at any time, without notice.
10.A Customers should be aware of the inherent risk of Alcohol abuse. Alcohol should be consumed in moderation.
10.B Cases of wine are heavy so extra care should be taken when lifting them.
10.C Nothing in these Terms of Sale shall affect our liability for death or personal injury arising from our negligence, nor our liability for fraud, nor any other liability, which cannot be excluded or limited under applicable law.
Intellectual Property Rights and Privacy
11.A All present and future copyright, design rights, unregistered designs, database rights, registered and unregistered trade marks and any other present and future intellectual property rights and rights in the nature of intellectual property rights existing in and to the site including content published on them such as text, graphics, logos, banners, images, buttons, underlying source code and software, are owned by us or the applicable licensor. Nothing in these terms shall be construed as an assignment to you of any such intellectual property rights.
11.B Any use (including copying, reproduction, duplication, transmission, or display of the content of this website, without our express written permission) for purposes other than the viewing of information or for ordering purposes is strictly prohibited.
11.C Permission is granted to electronically copy, and to print in hard copy, portions of the site for the sole purpose of placing an order with us or using the sites as a shopping resource.
11.D User comments and content:
You may post reviews, ratings, messages, comments and other content which may be disclosed, submitted or offered to us on or through the site or otherwise (“Submissions”). This right is extended on condition that the submissions are not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable. Specifically, submissions should not include software viruses, political campaigning, commercial solicitation, chain letters or mass mailings. You are solely responsible for your submissions. We reserve the right, but not the obligation, to remove or edit any submissions.
If you disclose, submit or offer any submissions, unless indicated otherwise, you:
Grant us a non-exclusive, irrevocable, perpetual, royalty-free and fully sub-licensable right to use, reproduce, publish, modify, adapt, translate, distribute, create derivative works from, and display such submissions throughout the world in any media. Grant all sub-licensees the right to use the name that you submit in connection with such submissions, if we so choose. Agree to waive your right to be identified as the author of such submissions and your right to object to derogatory treatment of such submissions. Represent and warrant that you own or otherwise control all of the rights to the submissions; that, as at the date the submission is disclosed, submitted or offered to us, such submission is true, accurate and not misleading; use of the submission will not cause injury to any person or entity (including that it is not defamatory), does not include the trade secret or confidential information of others and does not infringe any other person’s or entity’s rights. You agree to indemnify us for all claims brought by a third party against us arising out of or in connection with a breach of any of these warranties.

13.A We reserve the right to suspend your use of the site at any time for operational, regulatory, legal or other reasons. We may terminate your use of the site and/or your account with us with immediate effect if you breach any of these Terms.
Amendments to these Terms
14.A We may update or amend these Terms from time to time to comply with law or to meet our changing business requirements by amending this page without notice to you. You are expected to check this page from time to time to take notice of any changes made. Such changes will be effective as soon as they are posted on the Sites. By continuing to use the Sites or purchase products, you agree to be bound by the terms of these updates and amendments.
14.B The laws of England govern our terms and the English courts will have jurisdiction over any disputes arising under or in relation to them and any contract made under them. If any of these terms are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of the terms remain in full force and effect.
14.C Only you and we are entitled to enforce these terms. No third party is entitled to enforce any of these Terms, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.
14.D We may freely transfer or assign any portion of our rights or delegate our obligations under these terms. You are not entitled to transfer or assign, by operation of law or otherwise, any portion of your rights or delegate you obligations under these terms without our prior written consent.

PRIZE DRAWS | RAFFLES | COMPETITIONS
15.A By signing up to or having an account with Winesonline you are automatically entered into our prize draw and may win a prize.
15.B Each month we will draw a name from our customer base to win that months prize, be it a bottle or a case. Click here for this months prize information
15.C Winesonline reserve the right to cancel the competition, or not draw a winner, if the agreed amount of monthly sign-ups is not met.
15.D We will draw prizes for anything over 50 additional customers added in the monthly period. This count will be reset on 1st of each month.
15.E Winesonline reserves the right to cancel or amend the Competition or these Rules at any time without prior notice.
15.F One entry per household. All entrants must be aged 18 or over. All entrants must be registered with www.wineon-line.co.uk
15.G Membership is free. To qualify to enter the Competition you must be resident in the United Kingdom. Winners will be drawn from our database of members at midnight GMT on the last day of the month.
15.H The prize draw and prize details will be announced via email and the winners are required to notify Winesonline Ltd of the acceptance of their prize within 24 hours of notification. In the event of non-acceptance within the specified period, or if the person is not contactable, Winesonline Ltd reserves the right to forfeit the prize.
15.I Prizes are non-transferable and there is no cash alternative.
15.J In the event of any dispute regarding the competition, the decision made by Winesonline is final and no correspondence or discussion shall be entered into.
